Terms of Service
Rules for using artbalitravel.pl and signing up for Art Bali Travel boutique journeys.
These terms set out the rules for using artbalitravel.pl and the general principles for signing up for Art Bali Travel journeys. The detailed conditions of each journey (itinerary, price, payment schedule, cancellation) are always set out in the agreement signed with the Participant before departure. In case of any discrepancy, the agreement prevails.
§ 1. General provisions
- The website artbalitravel.pl (the "Website") is operated by M&M Marcin Marcińczak (trading as Art Bali Travel), ul. Widokowa 8, 78-111 Ustronie Morskie, Poland, VAT/NIP 6711639780; contact person: Malwina Marcińczak, e-mail: kontakt@artbalitravel.pl, phone +48 514 895 277 (the "Organiser", "we").
- The Website is informational: it presents boutique cultural journeys to Indonesia, allows you to send an enquiry or sign-up request, subscribe to the newsletter and read published content (the "Archipelago of Stories" blog, gallery, practical information).
- Using the Website is free of charge and does not require an account.
- Users must be at least 18 years old. Minors may take part in journeys only accompanied by a parent or legal guardian, under the conditions set out in the agreement.
§ 2. Definitions
- Journey — a boutique cultural trip to Indonesia described on the Website (itinerary, dates, indicative price, number of places).
- Enquiry — a message sent via the contact form, e-mail, WhatsApp or Messenger in which the User expresses interest in a Journey or requests information.
- Participant — a person who has concluded a Journey agreement with the Organiser.
- Agreement — the Journey participation agreement concluded in writing or by e-mail, which sets out all the conditions of the trip.
§ 3. Journey information and prices
- Journey descriptions on the Website are an invitation to talk and conclude an agreement, not a binding offer. The itinerary may change for reasons beyond the Organiser's control (weather, local conditions, religious holidays, decisions of authorities), always preserving the character and standard of the Journey.
- Prices on the Website are total prices per person and include exactly what is listed in the "Included" section of a given Journey. Items listed under "Not included" (e.g. international flights, insurance, personal expenses, some local fees quoted in USD) are paid by the Participant separately or on site.
- The number of places on each Journey is limited (usually 10–12 people). Places are allocated in the order deposits are received.
§ 4. Enquiry and conclusion of the agreement
- An enquiry sent through the Website is not yet a booking. We reply within 24 hours (on working days), provide details, answer questions and — if places are available — send a draft Agreement.
- The Agreement is concluded once both parties accept it and the deposit is paid in the amount and by the date indicated in the Agreement (typically 20% of the Journey price). The remaining balance is paid by the date specified in the Agreement.
- The Participant must provide accurate details needed to organise the Journey (name as in passport, date of birth, contact details, dietary and health information relevant to safety).
- Withdrawal from the Agreement, change of Participant, cancellation of a Journey by the Organiser (e.g. minimum group size not reached or force majeure) and refunds are governed by the Agreement.
§ 5. Participant obligations
- The Participant is responsible for holding a valid passport (valid at least 6 months beyond the planned return date), required visas, vaccinations recommended for Indonesia, and travel insurance covering medical costs and accidents.
- The Participant undertakes to respect local law, rules of entry to temples and places of worship, guides' instructions, and the culture, nature and communities we visit.
- The Participant is liable for damage caused through their own fault during the Journey.
§ 6. Photos and journey materials
- We take photos and videos during Journeys. Publishing a Participant's image on the Website, social media or in Art Bali Travel promotional materials requires their separate, voluntary consent, which may be withdrawn at any time.
- Participants may share their own photos from a Journey — in doing so they grant us a free licence to use them as described above, with author credit if they wish.
§ 7. Newsletter
- Subscribing to the newsletter is voluntary and requires an e-mail address and ticking the consent box. The newsletter contains information about new journey dates, blog posts and Art Bali Travel events.
- You may unsubscribe at any time by e-mailing kontakt@artbalitravel.pl or clicking the unsubscribe link in a message.
§ 8. Copyright
- All Website content — texts, photos, videos, logo, itineraries — is protected by copyright and belongs to the Organiser or licensors. Copying, distributing or using it without written permission is prohibited.
- Quoting excerpts with attribution (artbalitravel.pl) for non-commercial purposes is permitted.
§ 9. Complaints
- Complaints regarding the Website or a Journey may be submitted to kontakt@artbalitravel.pl or in writing. Please describe the issue and provide contact details.
- We respond to complaints within 14 days of receipt.
- Consumers may use out-of-court dispute resolution, including the EU ODR platform (ec.europa.eu/consumers/odr).
§ 10. Liability
- We make every effort to keep the Website accurate and up to date. We are not liable for interruptions caused by technical reasons beyond our control or for the content of external websites we link to (Google Maps, Facebook, Instagram, YouTube).
- The Organiser's liability for the performance of a Journey is governed by the Agreement and applicable law.
§ 11. Personal data
The processing of personal data is described in the Privacy Policy and the GDPR Notice.
§ 12. Final provisions
- These terms apply from 3 September 2026. Changes are announced on the Website; agreements concluded earlier are governed by the version in force at the time of conclusion.
- Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
- Disputes with consumers are resolved by the court having jurisdiction under general rules.
